In the state of Florida, in addition to the driver, you might also pursue a claim against the owner of the vehicle. Florida has a law called the Florida Dangerous Instrumentality Doctrine. What that basically means is that the owner of that vehicle is equally responsible as the driver who caused the accident. One more important point is that through the investigation it’s important to know why, and how, that driver was using the vehicle, because if they were using it while on the job it’s possible, not always, but it’s possible that the employer might be held responsible if that vehicle was operating within the course and scope of the employment of that driver.
